Please read these Terms carefully. They cover the Earnly Family app, Safety/location features, Hub hardware and pairing, subscriptions, and our websites.
1. Acceptance of Terms
By downloading Earnly Family, creating an account, pairing an Earnly Hub, purchasing Hub hardware, or using earnlyus.com, you agree to these Terms & Conditions (“Terms”). If you do not agree, do not use Earnly. Parents or legal guardians must accept these Terms on behalf of any child under 18.
2. Who Earnly Is For
Earnly is a family money-skills and household coordination product for parents/guardians and children. Parent accounts are intended for adults 18+. Child accounts must be linked to and supervised by a parent or legal guardian.
3. The Services
Earnly may include: (a) the Earnly Family iOS app for chores, allowances, spending tracking, savings goals, school rewards, family balances, requests, investing education features, and Safety/family map features; (b) the Earnly Hub kitchen display paired to your family; and (c) our marketing and Hub shop websites. Features may change over time and may differ by device, region, or subscription tier.
4. Accounts & Responsibilities
You are responsible for your login credentials and for activity under your account and linked child accounts. Keep contact information accurate. Notify us promptly of unauthorized access. You are responsible for obtaining any consents required to add family members and to enable location sharing for Safety features.
5. Location, Safety & Family Tracking
If you enable location permissions, Earnly may collect and share location within your household so authorized family members can view locations on the family map / Safety experience. Location is optional. You can disable it in iOS Settings. Earnly is not a substitute for emergency services, professional security systems, or direct parental supervision. Location accuracy is not guaranteed and may be delayed or unavailable.
6. Simulated Balances & Money Features
Unless we expressly state otherwise and you complete any required banking partner onboarding, balances, allowances, chore rewards, transfers, and related money features may be simulated or educational and may not represent real bank deposits, debit cards, or FDIC-insured funds. You agree not to treat simulated balances as actual cash held by Earnly. Features labeled educational or simulated are for learning and household tracking.
7. Chores, Rewards & Parental Controls
Parents control chore assignment, approval, allowance settings, spending limits, school rewards, and child permissions. Earnly does not guarantee that children will complete chores or that any educational outcome will be achieved. You are responsible for setting age-appropriate rules for your household.
8. Investing Features
Any investing-related features are educational and may require parental approval for activity. Investing involves risk, including possible loss of principal. Past performance does not guarantee future results. Earnly is not a registered broker-dealer or investment adviser unless we expressly identify a licensed partner and you agree to that partner’s terms.
9. Subscriptions (Earnly Live) & App Store Billing
Paid subscriptions may be offered through Apple’s App Store. Pricing, renewal, and cancellation are governed by Apple’s terms and your Apple ID settings. Fees are generally billed in advance and are non-refundable except where required by Apple or applicable law. You can manage or cancel auto-renewal in your Apple Account subscriptions settings.
10. Earnly Hub Hardware Purchases
Hub devices sold on earnlyus.com are one-time hardware purchases processed by our payment provider (e.g., Stripe). Prices, shipping, and taxes are shown at checkout. Hub functionality requires pairing with a compatible Earnly Family account and a working internet connection. Hardware is subject to the return/refund policy stated at purchase or provided in order confirmation communications.
11. Acceptable Use
You agree not to misuse Earnly, including: unlawful activity; harassment; attempting to access another household’s data; interfering with the service; reverse engineering except where permitted by law; uploading malicious code; or using location/Safety features to stalk, intimidate, or harm anyone. We may suspend or terminate accounts that violate these Terms or pose risk to users or Earnly.
12. Intellectual Property
Earnly, the Earnly logo, app interfaces, Hub software, and related content are owned by Earnly LLC or its licensors. You receive a limited, non-exclusive, non-transferable license to use the services for personal household purposes while you comply with these Terms.
13. Third-Party Services
Earnly may rely on third parties (Apple, map providers, hosting/auth providers, payment processors). Your use of those services may be subject to their terms. We are not responsible for third-party outages or policy changes outside our control.
14. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, EARNLY DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, OR THAT LOCATION/SAFETY FEATURES WILL BE ACCURATE OR AVAILABLE AT ALL TIMES.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, EARNLY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID TO EARNLY FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $100.
16. Indemnification
You agree to defend and indemnify Earnly against claims arising from your misuse of the services, violation of these Terms, or infringement of others’ rights, except to the extent caused by Earnly’s willful misconduct.
17. Termination
You may stop using Earnly and close your account at any time. We may suspend or terminate access if you violate these Terms, fail to pay required fees, or if we discontinue the service. Provisions that by nature should survive (including ownership, disclaimers, and limitations) will survive termination.
18. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on this page and revise the “Last updated” date. Material changes may also be communicated in-app or by email. Continued use after changes become effective constitutes acceptance.
19. Governing Law
These Terms are governed by the laws of the United States and the State of Delaware, excluding conflict-of-law rules, unless mandatory consumer protections in your place of residence require otherwise.
